Extension of residence permit of an alien and of a person enjoying subsidiary protection

A residence permit may be extended, if:
•    the circumstances due to which the residence permit was issued have not ceased to exist and
•    no circumstance exists which constitutes the basis for revocation thereof.

Submitting of an application for extending the residence permit
An application for extending the residence permit shall be submitted 4 months before the date of expiry of the temporary residence permit to the Police and Border Guard Board (PBGB), by address Endla 13 (Tallinn) or by post:

By applying for extension of the residence permit, the following documents shall be submitted:
•    application form (an option to fill in electronically at PC screen or to print out and fill in by hand);
•    applicant’s identity document;
•    photo by 40x50 mm.


By filling in the application questionnaire, we ask to keep in mind that:
•    Application must be filled in legibly in Estonian or any other language;
•    All fields foreseen for filling in by the applicant, shall be filled in,
•    The writing used to fill in the fields of the application shall be of dark colour in order to guarantee that submitted information is preserved.
•    Persons’ names shall be written in the application according to the form of the name as written in the identity document or travel document of the applicant using the Latin alphabet.
•    An applicant shall write his or her signature in the specimen signature field of the application in dark-coloured writing (recommended diameter of the lines of the letter should be 0.85 mm). A specimen signature shall be written by evenly strong line and it shall not extend the lines of the specimen signature field.
•    An applicant of at least 15 years of age shall sign in the space provided. An applicant from 7 to 14 years of age may sign in the space provided. In the case of an applicant under 7 years of age, or a person with restricted legal capacity, the space for signature shall remain blank.

As a rule, the applicant shall submit the application personally. If it is not possible, this can be submitted by his/her representative. In case of a minor of under 18 years of age or for an alien with restricted legal capacity, acts related to extension of the residence permit are performed by his/her parent, guardian, if they are staying in Estonia and if this is not contrary to the rights and interests of the unaccompanied minor. Acts related to extension of the residence permit of the unaccompanied minor are performed by his/her guardian, guardianship authority, head of admission centre or a person authorised by him/her, if this is not contrary to the rights and interests of the unaccompanied minor. Before performing that act, the legal or authorised representative shall submit his/her identity document and document confirming his/her right of representation.
If an application is submitted by post then, instead of the identity document, a copy of such document may be submitted. If a copy of a document is added to the application, the applicant shall certify by his or her signature on each page of the document containing information that the copy corresponds to the original document. The name of the applicant and the date of signing shall be added to the signature.

Review of the application for extension of residence permit
The PBGB shall review the application for extension of residence permit or refusal of it within 3 months starting from submission of the application, but not later than 10 days before expiry of the temporary residence permit.
In case of deficiencies, the term for proceedings shall be suspended until these are eliminated. If the applicant fails to eliminate the deficiencies during the specified term or does not append all required documents, the PBGB shall refuse to review the application.
The PBGB may extend the above-mentioned term of processing of an application, if the checking of the data presented in the application, documents appended thereto and the justification of submission of the application takes longer than the term provided for reviewing the application.
The PBGB shall inform the applicant of the grant of a residence permit, of extension of the term of proceeding, of refusal to review the application or of refusal to grant the residence permit on the basis of contact data submitted in the application.

Revocation of residence permit
Temporary residence permit of a person having been granted an asylum or subsidiary protection shall be revoked, if:
•    a circumstance which constitutes the basis for refusal to grant or to extend the residence permit becomes known;
•    the person poses a threat to national security, public safety or public order
 
Temporary residence permit of a person being granted an asylum or subsidiary international protection, shall be revoked by the Police and Border Guard Board.
