What are the obligations of the employer with regard to the recruitment of an alien?

The sponsor is obliged to:

  • verify that the alien invited to Estonia would have a legal basis for the stay in Estonia
  • receive the alien in Estonia
  • provide the alien with accommodation, if necessary
  • bear the costs of the stay of the alien in Estonia and of their departure from Estonia, if necessary

When recruiting an alien, the employer is also under the obligation of notification.

What is the employer’s obligation of notification with regard to the recruitment of an alien?

The employer is under the obligation to notify the Police and Border Guard Board in writing of:

  • the commencement of the employment of an alien
  • a failure to conclude a contract of employment with an alien who has registered short-term employment;
  • a failure of an alien to commence employment
  • the premature termination of the contract of employment
  • the actual termination of the employment of an alien.

If the aforementioned facts are registered in the employment register with the Estonian Tax and Customs Board, the employer is under no obligation of notification.
