Owner of a vehicle
An owner of a vehicle is a natural or legal person who has the right of ownership of the vehicle. The owner of a vehicle is required to ensure proper use, required technical condition and adequate maintenance of the vehicle. If an owner of a motor vehicle grants the vehicle for use to another person, the owner is required to keep the following information - the first and last name, date of birth, personal identification code, address and driving license number of the person who used the vehicle - during six months after granting the use or expiry of the authorisation document to use the vehicle and to submit it, at request, to the person exercising traffic supervision.
 
Responsible user of a vehicle
A responsible user of a vehicle is a person who uses the vehicle under a contract for use or under a sale contract with reservation of ownership and who has been entered in the traffic register as the responsible user of the vehicle. A responsible user is also a representative designated by a natural person without an Estonian residence permit or by a legal person without Estonian registration and entered in the traffic register, whereas such representative should be an Estonian citizen, a natural person with an Estonian residence permit or a legal person registered in Estonia. The responsible user of a vehicle is subject to the same obligations as the owner of a vehicle, i.e., if the responsible user grants the vehicle for use to another person, the responsible user is required to keep the following information and to submit it, at request, to the person exercising traffic supervision: the first and last name, date of birth, personal identification code, address and driving licence number of the person who used the vehicle.

Owner of a vehicle and responsible user of a vehicle = person responsible for the vehicle

The regulation of the written cautioning procedure treats both, an owner of a vehicle and a responsible user of a vehicle entered in the traffic register, as persons responsible for the vehicle. The person responsible for the vehicle is required to ensure proper use, required technical condition and adequate maintenance of the vehicle in his/her use. The obligation to ensure proper use of the vehicle also entails the right and obligation of the owner to decide on the persons who can use the vehicle. Therefore, he/she is responsible for the manner and period of use of the vehicle by other persons and, consequently, must possess information on any other persons who used the vehicle during six months after granting the use or expiry of the authorisation document to use the vehicle.

Above all this obligation is granted by Traffic Act section 11 subsection 3, according to which a responsible person is obligated to have and store during the use of the vehicle by other person and within six months after the end of such use the data regarding who has been using his or her motor vehicle. The owner or responsible user of a vehicle must store given name and surname, address, number of driving licence, date of birth or personal identification code of the person who actually used the vehicle, and to share such data with the person exercising traffic supervision upon request of the latter.
The person responsible for the vehicle obtains such information by issuing an authorisation document to the user, because an authorisation document that grants the right to use a vehicle should include the aforementioned information. A breach of this obligation is separately punishable as misdemeanour.
